Short answer
How high must a scaffold guardrail be? The UK and US numbers
Two figures settle most cases: 950 mm in Great Britain and 38 to 45 inches in the United States. The rules underneath them, on gaps, toe boards and older rails, are where the two systems part ways.

How high must a scaffold guardrail be?
In Great Britain the top guard-rail must be at least 950 mm above the edge, and no unprotected gap may exceed 470 mm (Work at Height Regulations, Schedule 2). Under OSHA the toprail sits 38 to 45 in (0.97–1.2 m) above the platform, with a midrail about halfway and a toeboard at least 3.5 in high (29 CFR 1926.451).
How do the UK and US rail rules compare?
| Part | Great Britain: WAHR 2005, Schedule 2 | United States: 29 CFR 1926.451 |
|---|---|---|
| Top rail | At least 950 mm above the edge; 910 mm accepted for rails already fixed when the Regulations came into force (para. 3(a)) | 38–45 in (0.97–1.2 m) above the platform on scaffolds made or placed in service after 1 January 2000; 36–45 in on older ones ((g)(4)(ii)) |
| Middle protection | Intermediate rail positioned so that no gap exceeds 470 mm (para. 3(c)) | Midrail about halfway between toprail and platform ((g)(4)(iv)); screens or mesh must run from the toprail down to the platform ((g)(4)(v)) |
| Toe board | No height stated: toe-boards must be "suitable and sufficient" to stop a person, material or object falling (para. 3(b)) | At least 3.5 in (9 cm) high, with no more than 1/4 in clearance above the platform ((h)(4)(ii)) |
| Substitutes | HSE accepts another barrier if it is at least 950 mm high, secure and gives equivalent protection (HSE) | Crossbracing counts as a toprail if the braces cross 38–48 in above the platform, or as a midrail at 20–30 in ((g)(4)(xv)) |
When does an American scaffold need the rail?
The trigger is a platform more than 10 ft (3.1 m) above a lower level, 1926.451(g)(1); guardrails then run along all open sides and ends ((g)(4)(i)). The wall side counts too: if the platform's front edge is more than 14 in from the face of the work, it needs a guardrail or personal fall arrest ((b)(3)). The allowance is 18 in for plastering and lathing and only 3 in on outrigger scaffolds.
Strength matters as much as height. On most scaffolds the toprail must withstand 200 lb (890 N) and the midrail 150 lb (666 N), paragraphs (g)(4)(vii) and (ix).

Why does "42 inches" keep turning up?
It is the general construction figure: 1926.502(b)(1) puts the top edge at 42 in plus or minus 3 in, while scaffolds have their own range in Subpart L. A 42 in rail satisfies both, but a 38 in scaffold rail would sit below the 39 in floor of the general rule if someone reused it as roof-edge protection.
What does Schedule 2 not specify?
Schedule 2 fixes the top rail and the gap, not the hardware: no toe-board height, no mid-rail position. The components come from the system's instructions, a TG20:21 compliance sheet or a bespoke design; the UK regulations article covers those layers and the OSHA article the rest of Subpart L. See also guardrail and toe board.
ScaFix places rails and toe boards in its 3D plan and parts list; it does not certify them against Schedule 2 or 1926.451.
Planning information, not a compliance check. In Great Britain the system manufacturer's instructions or the TG20:21 compliance sheet set the rail components, and regulation 12 requires a working platform to be inspected in position by a competent person before it is used. In the US a competent person supervises erection and alteration under 1926.451(f)(7), and the manufacturer's instructions still apply.
Frequently asked questions
What is the minimum toe board height on a UK scaffold?
The Work at Height Regulations do not give one. Schedule 2 asks only that toe-boards be suitable and sufficient to stop a person, material or object falling, so the height comes from the scaffold system's instructions or the design.
Is the OSHA guardrail height for scaffolds 42 inches?
Not exactly. Scaffolds use a range of 38 to 45 in. The 42 in, plus or minus 3 in, figure is the general construction rule in 1926.502(b)(1); a 42 in rail meets both.
Can older frames with 36 inch rails still be used in the US?
Only if the scaffold was made or placed in service before 1 January 2000. Anything newer needs the toprail at 38 in or more.
Does a UK scaffold need a mid-rail?
Yes, or equivalent protection. Schedule 2 asks for an intermediate guard-rail placed so that no unprotected gap exceeds 470 mm, but it leaves the rail's exact height to the system instructions or the TG20:21 sheet.
Do I need a rail on the wall side of the platform?
Under OSHA, yes when the front edge is more than 14 in from the face of the work, unless personal fall arrest is used. Plastering and lathing allow 18 in, and outrigger scaffolds only 3 in.
