Short answer

Do I need a permit for scaffolding?

The permit question turns on where the scaffold stands. On or over a public highway, British law requires a licence from the highway authority; on private land, what matters is the scaffold's design and, for big projects, a notification.

Do I need a permit for scaffolding?

In England and Wales, a scaffold obstructing a highway needs a licence from the highway authority under section 169 of the Highways Act 1980; one wholly on private land does not. In the US it depends on the city: New York requires a permit for supported scaffolds over 40 ft, Chicago for any scaffold over the public way.

What does a section 169 licence commit you to?

The authority must issue the licence once you supply the particulars it reasonably asks for, unless the scaffold would cause unreasonable obstruction or a less obstructive structure could be used. A refusal, or terms you object to, can be appealed to a magistrates' court. Once licensed, you must:

  • keep the structure adequately lit from half an hour after sunset to half an hour before sunrise,
  • put up and maintain traffic signs as the authority directs in writing,
  • do what utility companies reasonably ask to protect or reach their apparatus.

The lighting and sign duties fall away where no part of the scaffold is within 18 in of the carriageway and nothing over the footway is lower than 8 ft. Scaffolding on the highway without a licence is an offence, with a fine up to level 5 on the standard scale. Councils run their own procedures: West Sussex, for example, asks for at least 10 working days' notice and wants to be told when the scaffold comes down.

How do US cities split the permits?

The two city examples split the question differently. New York's Department of Buildings ties the permit to the structure: every sidewalk shed, and supported scaffolds over 40 ft. Chicago separates the street from the building. Its Department of Buildings issues no building permit for scaffolding up to 40 ft, but the Chicago Department of Transportation must permit any scaffold on or over the public way, whatever its height. Chicago also requires written permission from the neighbour before a scaffold goes on or over adjoining private property, and on a scaffold that needs a building permit, everyone who erects, uses or removes it must carry proof of an approved safety course taken within the previous 4 years. Other cities set their own rules, so check the local building department.

Does the licence approve the scaffold itself?

No. It is a highway consent. The scaffold still needs a TG20:21 compliance sheet, the manufacturer's guidance or a bespoke design, and HSE warns against erecting or dismantling over people or busy pavements, suggesting a footpath or road closure where needed (HSE). The UK regulations article covers the design side, and the OSHA article the federal rules that apply wherever a US scaffold stands.

For house jobs, see scaffolding for a house and how to plan a facade scaffold. A ScaFix plan shows how far the scaffold runs along and out from each wall, which helps when the council asks for the structure's particulars.

General information, not legal advice. The highway authority's licence terms and conditions decide what you must do on the highway, and in the US the local building code decides whether a permit is needed.

Frequently asked questions

Do I need a scaffold licence if the scaffold is in my front garden?

Not under section 169, which covers structures on or over a highway. If any part overhangs the pavement, it is over the highway and needs the licence.

Does a licensed scaffold need lights at night?

Yes, from half an hour after sunset to half an hour before sunrise, unless no part is within 18 in of the carriageway and nothing over the footway is below 8 ft.

How much notice does a council need for a scaffolding licence?

Councils set their own procedures. West Sussex, for example, asks for at least 10 working days' notice from the date of application.

Does a scaffold in Chicago need a permit?

Over the public way, always: the transportation department permits scaffolding of any height on or over a street, alley or sidewalk. A building permit is needed only above 40 ft.

Does every scaffold in New York City need a permit?

No. The Department of Buildings requires one for every sidewalk shed and for supported scaffolds over 40 ft, filed through DOB NOW: Build.
